What is outstanding car finance?

When a vehicle is bought on HP or PCP, the lender holds the legal title for the life of the agreement. The person making monthly payments is the registered keeper on the V5C, but the credit provider is the owner in law — and that ownership does not transfer until the very last payment clears.

For a private buyer, this gap between keeper and owner creates serious risk. The seller has full possession of the car and can show you a V5C in their name — but without legal title, they have no authority to sell it. If you hand over money and the finance remains active, the lender can reclaim the vehicle from you with no obligation to refund your purchase price.

The V5C is a keeper record, not a title document. It does not establish who owns the vehicle, and it cannot be used as evidence of the right to sell. A finance company's name rarely appears on the V5C— which is exactly why a dedicated check is essential.

What actually happens if you buy a car with finance?

Under UK law, a car on hire purchase (HP) or PCP is legally owned by the finance company — not the seller — until the final payment is made. If you buy that vehicle without checking, the finance company can legally repossess it from you at any time. You'll have no car and no refund from the seller, who by that point is typically impossible to trace.

Agreement Types

Types of Finance We Check For

All four common UK finance agreement types are identified — each carries its own risk profile.

Hire Purchase (HP)

Legal owner: Finance company

Fixed monthly payments spread over an agreed term. Legal title stays with the finance company throughout — you only own the car once the final payment clears. HP is the most common agreement type and one of the most frequently found on history checks.

High — lender can repossess at any point before final payment.

Personal Contract Purchase (PCP)

Legal owner: Finance company

Monthly payments cover the depreciation, not the full value. At the end of the term, you can pay a 'balloon payment' to own the car, hand it back, or use any equity in a new deal. Until the balloon is paid, the finance company is the legal owner.

High — legal ownership never transfers unless the balloon payment is made.

Lease Purchase (LP)

Legal owner: Finance company

Similar to PCP — monthly payments followed by a final balloon payment. Unlike PCP, you are contractually obligated to make the balloon payment at the end. Title only transfers once all payments, including the balloon, are settled.

High — legal title remains with the lender until every payment is complete.

Logbook Loan

Legal owner: Lender (physically holds V5C)

A short-term secured loan where the borrower signs over legal title via a Bill of Sale. The lender's name is registered on the V5C for the duration and the borrower retains day-to-day use of the vehicle — but cannot transfer it to anyone else while the loan runs.

Very high — the lender may physically hold the V5C and can repossess without a court order.

Money paid to a private seller goes to them — it does not automatically clear the finance. The credit agreement can only be closed by the lender confirming full repayment.

Request a settlement letter

Ask the lender for an official settlement letter confirming the agreement has been fully repaid and their interest released. A genuine seller will support this.
